Application Flexibility

• Visas Expiring Prior to Changes: Those holding Short-term stream TSS visas that expire before the effective date of the changes will still need to leave Australia to apply for a third or subsequent visa.

Comprehensive Changes to the TRT Stream of the ENS and RSMS Visas

Eligibility Expansion for Nominations

• All TSS Streams: Employers will now be able to nominate individuals from all TSS visa streams, including those on Short-term and Labour Agreement streams, for ENS/RSMS visas.
• Visa Holding Duration: The nominee must have held their TSS (or subclass 457) visa(s) for at least two years within the three-year period preceding the nomination.
• RSMS Continuity: The RSMS visa remains exclusive to transitional 457 and transitional 482 visa workers.

Occupation Requirements Liberalization

• No More Occupation Lists: The requirement for nominated occupations to be assessed against skilled migration occupation lists will be eliminated.
• ANZSCO Listing: The nominated occupation must be recognized in the ANZSCO, and the nominee must continue in the occupation for which their TSS visa(s) were granted.

Work Experience Requirements Adjustment

• Reduced Period of Employment: The time TSS visa holders are required to have worked with their sponsoring employer (or in the occupation for certain categories like medical practitioners and executives) will be reduced to two years within the three years before the nomination.

Changes to Visa Requirements for the TRT Stream

Age Exemption Revisions

• Regional and High-Income Earners: There will be new age exemptions for regional medical practitioners and high-income earners aged 45 and over, allowing for a two-year pathway to PR.
• End of COVID-19 Exemptions: With the introduction of the two-year pathway, certain COVID-19 related age exemptions will be discontinued as they will no longer be necessary.
